EU laws concerning flight delays
One of the most frustrating types of holiday claims is experiencing delays with your flights. Should you experience a delay while flying, your compensation might be dependant on your airline. There are, however, specific compensation laws within the EU that cover your compensation rights. Generally, when your flight is delayed for over 3 hours, your airline should give you:
- Food and drink
- Access to calls and emails
Make sure to ask someone who works for the airline if no one is offering you help when you’re delayed.
If your flight is delayed more than 3 hours
Your flight will need to be delayed by at least 3 hours for you to be entitled to receive compensation. This is also only the case if your delay was the airlines fault, and not due to something out of their control such as bad weather or a security problem. You’ll be entitled to receive the items listed above as well as a monetary compensation which is based on the distance of your flight.
- If you were delayed by 3 hours or more and set to travel less than 1500 km, you’re entitled to €250.
- If you were due to travel between 1500 and 3500 km or more than 1500 km and within the EU, you’re entitled to €400.
- If you were delayed by 3-4 hours and set to travel more than 3500 km between an EU and non-EU airport, you’re entitled to €300.
- If you were delayed by 4 hours or more and set to travel 3500 km or more between an EU and non-EU airport, you’re entitled to €600.
If your flight is delayed more than 5 hours
If your flight is delayed by more than 5 hours, you’re under no obligation to take your flight. If you decide not to take your flight, your airline legally needs to provide you with a full refund for that flight and any other flights in the same journey (onward or return flights), and a flight back to your original departure airport if you’re partway through a journey.
If you decide you want to take your flight anyways, you’ll be entitled to €600 compensation from the airline if the delay is their fault. If the delay was due to something out of their control, you’ll be less likely to be compensated.
What if your delayed holiday happened a few years ago?

What if a shorter delay causes you to miss a connecting flight?

If the delay on your connecting flight causes your long-haul flight to arrive over 3 hours late, you’ll be entitled to claim for your long-haul flight compensation too.
